Eliquis's 1 April 2028 earliest US generic date is a company statement from 2021, subject to appeals. The Orange Book does not carry it.

The Bristol Myers Squibb-Pfizer Alliance (the Alliance) said in September 2021 that the earliest date generics may launch apixaban in the US is 1 April 2028, subject to additional appeals and challenges. The Orange Book lists the composition patent to November 2026 and the formulation patent to February 2031, with a new patient population exclusivity entry ending on 17 April 2028. None of the three is the date the Alliance gives. This brief sets the sources side by side and says what each one does and does not establish.

Three sources, three different dates
The earliest US generic launch date the Alliance gives for Eliquis is 1 April 2028. It is the originator's stated date. What matters for anyone planning around it is where it comes from, because the Orange Book listing for Eliquis does not carry it.
In a press release of 3 September 2021, the Alliance welcomed the Federal Circuit decision affirming the August 2020 District Court ruling that the composition of matter patent (US 6,967,208) and the formulation patent (US 9,326,945) were valid and infringed. The release states that, given the decision, the earliest that generic manufacturers are permitted to launch their apixaban products is 1 April 2028, and adds that this is "subject to additional appeals and challenges". The Bristol Myers Squibb newsroom copy is the primary source.
The FDA's Orange Book says something else, and says it in several lines. The thesis of this brief is that a reader who works from the register alone will arrive at a different year from the one the Alliance gives, and that the difference is a matter of what each source is built to record.

Sources: Orange Book listing for NDA 202155 (products 001 and 002); Bristol Myers Squibb-Pfizer Alliance release; BMS Form 10-K for 2025; Pfizer Form 10-K for 2025. The table sets out what each source records. It does not reconcile them, and no source we read does.
What the Orange Book lists, and what it leaves out
The Orange Book listing for Eliquis (NDA 202155, tablets 2.5 mg and 5 mg, products 001 and 002) carries the composition of matter patent to 21 November 2026, with a pediatric exclusivity entry to 21 May 2027, and the formulation patent to 24 February 2031, with a pediatric entry to 24 August 2031. The 24 August 2031 date is the pediatric extension of a patent whose listed expiry is six months earlier.
The same listing shows new patient population exclusivity ending on 17 April 2028, with a pediatric entry to 17 October 2028. The Orange Book is a register of patents and exclusivities. It does not record settlement terms, licences or agreed launch dates, and no line on the listing for either strength reads 1 April 2028.
What the originator's own filings say
BMS's Form 10-K for 2025 states that it has settled with a number of generic companies, and that those companies are permitted to launch in 2028. The same filing describes trial and appeal wins against others. That is the basis in a primary source for describing part of the 2028 position as settled. The BMS excerpt we could read gives the year only and does not tie the specific day, 1 April, to the settlements. Pfizer's filing does, as set out below. Neither gives the settlement terms, and we state none.
The 2021 release qualifies its own date. The qualifier is the originator's wording, and it is a reason to read the date as a statement of position at that time rather than a guarantee. We looked for a later BMS or Pfizer statement giving a different date and did not find one in the filings we read. BMS's 10-K for 2025 gives the year, 2028, and not the day. Pfizer's gives the day, 1 April 2028, for the settled companies.
Pfizer's Form 10-K for 2025 describes the position from the other alliance partner. Its footnote on Eliquis patent expiry says that settlements permit the settled generic companies to launch a generic version of Eliquis on 1 April 2028, and that Pfizer continued to litigate against three remaining generic companies. It says that after that litigation was resolved in Pfizer's favour, the three are not permitted to launch until the 2031 expiry of the formulation patent. The footnote, as we read it, names no generic company.
The same footnote lists two ways an earlier launch might occur. If the formulation patent were held invalid or not infringed in future litigation, through appeal, it says the settled companies and any successful future litigant would be permitted to launch on 21 November 2026. If both patents were so held, it says they could launch immediately on such a decision. It adds that the composition of matter patent, expiring in November 2026, and the formulation patent may both be subject to future challenges. These are Pfizer's descriptions of scenarios. We do not say that any of them will occur.
The litigation behind the patents
According to the Alliance's release, the district court ruling of August 2020 concerned US 6,967,208 and US 9,326,945. The Federal Circuit decided Bristol-Myers Squibb Company and Pfizer Inc. v. Sigmapharm Laboratories, LLC, Sunshine Lake Pharma Co. Ltd., HEC Pharm USA Inc. and Unichem Laboratories, Ltd. on 3 September 2021 (Nos. 2020-2229, 2020-2252 and 2020-2258), and the court lists the opinion as nonprecedential.
BMS and Pfizer are the plaintiffs-appellees and the four generic companies are the defendants-appellants. The appeals came from four District of Delaware actions before Judge Leonard P. Stark (Nos. 1:17-cv-00374-LPS, 1:17-cv-00380-LPS, 1:17-cv-00382-LPS and 1:17-cv-00408-LPS). The Alliance's release describes the decision as affirming the August 2020 ruling.
That sequence is not the whole record for the formulation patent. BMS's Form 10-K for 2025 (Note 20) and its Form 10-Q for the quarter ended 30 June 2026 (Note 18) say that in November 2025 BMS received a notice letter from Azurity Pharmaceuticals, Inc. (Azurity). Azurity, BMS says, had filed a 505(b)(2) application, a form of new drug application that is not an ANDA, containing a paragraph IV certification.
The filing seeks approval to market apixaban products in the US and challenges a formulation patent listed in the Orange Book for Eliquis, not the composition of matter patent. BMS says it and Pfizer then brought a patent infringement action against Azurity in the US District Court for the District of Delaware.
The court docket for that action (No. 1:25-cv-01558), as copied on CourtListener from the federal court record, lists Bristol-Myers Squibb Company and Pfizer Inc. as plaintiffs and Azurity as defendant. It shows a complaint filed on 23 December 2025, a report to the Commissioner of Patents naming US 9,326,945, and the case terminated on 5 October 2026 after a stipulation on 2 October 2026. The entries we read do not show the terms, CourtListener notes that its copy may not be up to date, and we do not say why the case ended.
A CourtListener search of District of Delaware dockets for "Bristol-Myers" and "9,326,945", filed since 1 January 2022, also returned three earlier actions brought by Bristol-Myers Squibb Company: against Biocon Pharma Limited (No. 1:23-cv-00392, filed 6 April 2023, terminated 21 June 2023), ScieGen Pharmaceuticals, Inc. (No. 1:23-cv-00393, filed 6 April 2023, terminated 27 April 2023) and Umedica Laboratories Pvt. Ltd. (No. 1:24-cv-01089, filed 30 September 2024, terminated 15 October 2024). We did not open those three dockets and we do not say why any of them ended.
Both patents were searched by number for litigation on 15 October 2026, and US 9,326,945 again on 26 October 2026. We read the first page of the Federal Circuit opinion and did not reach the 2017 to 2021 district court dockets, so every statement about the outcome of that sequence is attributed to the party making it. We read Note 20 of the 10-K in excerpts, not in full.
Approvals are a separate fact from launch
Drugs@FDA data, read through openFDA on 26 October 2026 (data last updated 23 October 2026), lists 27 applications for apixaban: 23 ANDAs and 4 NDAs. Thirteen of the ANDAs carry full approval and ten are at tentative approval only. The register lists 27 sponsor names, one per application. The originator appears under two of them, so there are at most 26 companies.
We did not check other parent and subsidiary links. We examined the Eliquis NDA (202155) and did not examine the other three NDAs (220073, 220446 and 221024), so we say nothing about what they cover. An application is not a company, so the counts of applications, sponsors and companies are not interchangeable.
Tentative approval means the FDA has finished reviewing an ANDA and found that it otherwise meets the requirements for approval, but cannot approve it while a patent or exclusivity stands (21 CFR 314.105(d)). A tentatively approved product is not an approved drug and may not be marketed. Full approval is not a launch. We found no dated company source showing a US generic apixaban on the market.
The Alliance's 2021 release gives 1 April 2028 as the earliest permitted launch date, and BMS's 10-K for 2025 gives 2028 for the companies it has settled with. Our not finding a launch is not evidence that none exists, and nothing here is a forecast of any company's launch date.
Europe is a separate clock, and BMS dates it to November 2026
BMS's 10-K for 2025 puts the expiry of the European composition of matter patents and supplementary protection certificates for apixaban in November 2026, and reports generic apixaban already marketed in certain European countries. The European position and the US position should not be read as one clock. The US composition patent also lists to November 2026 on the Orange Book. We have not examined whether the two dates share a cause, and nothing here says they do.
Medicare and the sales base
Eliquis revenues were $4,481 million in the three months to 30 June 2026, against $3,680 million in the same quarter of 2025, an increase of 21.8% at reported exchange rates (Phontix AI calculation from the two Form 10-Q figures; BMS reports 22%). BMS's second-quarter results release of 30 July 2026 gives the split: US revenues of $3,357 million, against $2,654 million, up 27%; and International revenues of $1,124 million, against $1,027 million, up 9% at reported rates and 7% excluding foreign exchange.
It reports worldwide growth of 22% at reported rates and 21% excluding foreign exchange, and says that demand increased for Eliquis. The Form 10-Q table we read gives no Eliquis split, and we give no cause for the movement beyond that statement.
Eliquis was selected for initial price applicability year 2026 under the Medicare Drug Price Negotiation Program, and CMS dates its fact sheet for that selection to August 2023. CMS gives 1 January 2026 as the date negotiated prices go into effect, and BMS's 10-K for 2025 says the Medicare price for Eliquis applies from that date.
CMS also states that a selected drug ceases to be subject to negotiation where FDA has approved a generic that identifies the selected drug's product as its reference-listed drug and the generic is marketed pursuant to that approval. On that wording, approval without marketing does not trigger removal. Eliquis did not appear in CMS's deselection table when we read the page on 26 October 2026. We assume no date at which Eliquis leaves the programme.
What the record does not settle
The record does not settle which companies, if any, hold a licence to launch on 1 April 2028; the terms of any settlement; the terms on which the Azurity action ended; whether any appeal or challenge will move the date; the relationship between the 1 April 2028 date and the 17 April 2028 exclusivity entry; or which, if any, of the fully approved applications have launched. Each is stated as open below.
How to read this if you are deciding whether to build
- A planning date for US generic apixaban should name its source. The Alliance's earliest date is 1 April 2028, from a statement dated 3 September 2021, subject to further appeals and challenges.
- Company filings give more than one date. Pfizer's 10-K for 2025 describes 1 April 2028 for settled companies, the 2031 formulation patent expiry for three others, and scenarios in which launch could come earlier. Read each as the company's description, not a forecast.
- The Orange Book dates for Eliquis are 21 November 2026 for the composition patent and 24 February 2031 for the formulation patent, each with a pediatric entry six months later, plus an exclusivity entry to 17 April 2028. None of them is a launch date.
- Approval and launch are separate facts. Thirteen ANDAs hold full approval and ten are at tentative approval only, and we found no dated source showing a US generic on the market.
- Europe runs on its own dates. BMS gives November 2026 for the European composition patents and SPCs and reports generics already marketed in some countries.
- If a date comes from an analyst site, find the primary source before using it.
- Check the litigation record by patent number, not by the 2021 decision alone. The formulation patent was the subject of a 2025 action against Azurity, which the docket lists as terminated on 5 October 2026 with no terms shown.

Frequently asked questions
When can generic Eliquis launch in the US?
The Bristol Myers Squibb-Pfizer Alliance stated on 3 September 2021 that the earliest date generic manufacturers may launch apixaban in the US is 1 April 2028, subject to additional appeals and challenges. It is a company statement, not an FDA register entry, so it does not establish a launch date for any named generic company.
Is the 1 April 2028 date in the FDA Orange Book?
No line on the Orange Book listing for either Eliquis strength reads 1 April 2028. The listing shows the composition patent to 21 November 2026, the formulation patent to 24 February 2031, and new patient population exclusivity to 17 April 2028, each with a pediatric entry six months later. The register does not record settlement terms.
Has the 2028 date been settled with generic companies?
Pfizer's 10-K for 2025 says settlements permit a number of generic companies to launch on 1 April 2028, and that three others are not permitted to launch until the 2031 formulation patent expiry. BMS's 10-K gives the year, 2028. The excerpts we read name no company and give no settlement terms.
Does full FDA approval of a generic apixaban mean it is on sale?
No. Approval, launch and marketing are separate facts. A tentatively approved application is one the FDA has reviewed but cannot make effective while a patent or exclusivity stands. We found no dated source showing a US generic apixaban on the market. The Alliance's 2021 release gives 1 April 2028 as the earliest launch date; BMS's 10-K for 2025 gives 2028.
Is the European position the same as the US one?
No. BMS reports that the European composition of matter patents and supplementary protection certificates for apixaban expire in November 2026, and that generics are already marketed in certain European countries. The US dates come from separate patents, a separate register and a separate disclosure, and should be read as a separate clock.

LOE Edge brings FDA records for a molecule into one view: approvals, applications, and the patents and exclusivity listed in the Orange Book. Book a demo and we will walk through a molecule with you.
Methodology and sources
US patent and exclusivity dates come from the FDA Orange Book listing for NDA 202155 (products 001 and 002), read on 26 October 2026. Approval counts come from Drugs@FDA data read through openFDA on 26 October 2026, with two applications checked on Drugs@FDA. The 1 April 2028 date comes from the Bristol Myers Squibb-Pfizer Alliance press release of 3 September 2021, and the case details from the first page of the Federal Circuit opinion.
Settlement, European and Medicare statements come from BMS's Form 10-K for 2025, and the settled and remaining generic companies are described in Pfizer's Form 10-K for 2025. The Azurity action comes from Note 20 of that filing and Note 18 of the Form 10-Q, with the docket facts from CourtListener's copy of the federal court record.
The latest-quarter figures, including the US and International split, come from BMS's second-quarter 2026 results release and its Form 10-Q for the quarter ended 30 June 2026. CMS wording was read on its selected drugs page. Litigation is described through the Alliance's release, the court's own opinion, BMS's filings and the CourtListener docket copies. No syndicated market research forecast is used anywhere in this brief and no market size has been estimated.
